§1 Definitions
The terms used in the Rules and Regulations shall mean:
Customer - a natural person with full legal capacity, a legal person or an organisational unit which is not a legal person, to which legal capacity is granted by special regulations, who places an Order in the Online Shop;
Seller - OLKI Sp. z o.o. , with its registered office at Zgłobicka Street 33-113 Zgłobice, entered in the National Court Register.

Online Store - the online service available at www.manufakturanatura.pl through which the Customer may in particular place Orders;
Rules and Regulations - these Rules and Regulations for providing electronic services to the Customers of the Internet Shop;
Goods - products or services presented in the Internet Shop;
Order - Customer's declaration of will aiming directly at concluding the contract of sale, specifying in particular the type and number of Goods;
Contract of sale - a contract of sale of Goods, as defined by the Polish Civil Code, concluded between OLKI Sp.zo.o. and the Client via the Online Shop;
Basket - the functionality of the Internet Shop www.manufakturanatura.com , in which the Goods selected by the Client for purchase are visible, as well as enabling the Client to establish and modify order data;
Customer's individual account - a functionality of the Internet Shop www.manufakturanatura.com, giving the possibility to make purchases without re-entering the Customer's identification data, and to take part in competitions for customers
Civil Code - the act of 23 April 1964. Civil Code (Journal of Laws No. 16, item 93 as amended);
Act on providing services by electronic means - Act of 18 July 2002 on providing services by electronic means (Journal of Laws No. 144, item 1204 as amended);
Newsletter - information bulletin of the Internet Shop www.manufakturanatura.com containing, in particular, information about current prices and promotions;
Consumer Rights Act - the Act of 30 May 2014 and consumer rights (Journal of Laws of 24 June 2014, item 827)
Distance contract - a contract as defined in Article 2(1) of the Act of 30 May 2014 on consumer rights, i.e. a contract concluded with a consumer under an organised system for concluding distance contracts, without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract;
Durable medium - material or tool as defined in Article 2(4) of the Act of 30 May 2014 on consumer rights, i.e. allowing the consumer or entrepreneur to store information addressed personally to him/her in a manner that allows access to the information in the future for a period of time appropriate to the purposes of the information, and that allows the reconstruction of the stored information in an unchanged form; in particular, the transfer of information on a durable medium shall be understood as the transfer of information via e-mail
Consumer - a customer who is a consumer within the meaning of Article 22 of the Civil Code
§2 General provisions
These Regulations define the principles of use of the Online Store and are regulations referred to in Article 8 of the Act on Providing Services by Electronic Means, and fulfils the informational obligations of the entrepreneur to the customer who is a consumer, as required by the Act on Consumer Rights.
These Regulations define, in particular:
Rules for registration and use of an individual Customer account within the Internet Shop;
Terms and conditions for placing electronic Orders in the Internet Shop;
Rules of concluding Sales Agreements using the services provided by the Online Store.
Information obligations of the trader to the customer who is a consumer, as defined in the Consumer Rights Act
Contracts through the Online Store may be concluded by natural persons who have full legal capacity, legal persons and organizational units without legal personality, which are granted legal capacity by the law.
Information about the Goods given on the websites of the Store, in particular their descriptions, technical parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.
Information about the price given on the website www.manufakturanatura.com is binding from the moment the Customer receives an e-mail containing the final confirmation of all important elements of the Order.
§3 Rules of using the Internet Shop
Browsing through the Online Store is possible without logging in first, however making purchases requires Client registration, an individual Client account.
Each time you log in at the Web Site, it is tantamount to accepting these Terms and Conditions, Privacy Policy and Price List.
Each time the Goods are ordered at the Website, it is tantamount to accepting the conditions of providing the Service, contained in a document or documents (in the form of Regulations and others) describing the principles of providing sales by the Internet Shop. The current content of these documents is publicly available on the Online Store website www.manufakranatura.com.
In order to register at the www.manufakturanatura.com online shop, you need to fill in a registration form, providing your name and surname or - in the case of a legal person or organisational unit without legal personality, to which the law grants legal capacity - company name, e-mail address and password, accept these Terms and Conditions and agree to the processing of the Customer's personal data to the extent necessary to carry out the Order.
Registration in the Internet Shop and using its functionalities are free of charge.
After registering in the Internet Shop, each time logging in takes place using data provided in the registration form.
The Customer undertakes to keep the unique login and password assigned during registration secret and not to make it available to third parties. In the event of a suspicion that knowledge of the content of the login and password may have been acquired by a third party, the Customer is obliged to change the password and inform immediately the online shop www.manufakturanatura.com about this fact.
Any Goods ordered after the Customer has logged in with a unique login and password shall be deemed to have been ordered by the Customer.
The Customer cannot evade any responsibility towards the Online Store www.manufakturanatura.com (including payment), if the Order is made with the use of a unique login and password assigned to the Customer.
In order to unregister from the Online Store www.manufakturanatura.com an e-mail message with a request to unregister should be sent to mn@manufakturanatura.com.
The Seller can deprive the Client of the right to use the Internet Shop, as well as limit its access to a part or all resources of the Internet Shop, with immediate effect, in case of violation of the Regulations by the Client, and in particular, when the Client acts within the Internet Shop in a manner that violates generally applicable laws, rights and personal interests of third parties, rules of social coexistence or provisions of these Regulations, as well as when the Client fails to collect ordered Goods at least twice.
A person who has been deprived of the right to use the Internet Shop, shall not register again without prior consent of the Company.
The goods offered in the Store are intended solely for cosmetics and external use. The Shop bears no responsibility for the use of the offered products contrary to the recommendations or beyond the recommendations placed on the Shop's website. The Store's liability is limited to the guarantee of the cosmetic properties of the products offered and does not cover losses resulting from their use outside the Store's control, therefore the Store assumes no liability for special, indirect or consequential damages resulting from the use of the products offered by the Store.
§4 Procedure for conclusion of a Sales Agreement
In order to conclude a Sales agreement by means of the On-line shop, the Customer shall first register on the website www.manufakturanatura.com, log in and then select the Goods, taking subsequent technical actions on the basis of messages displayed to the Customer and information available on the website.
The choice of ordered Goods by the Customer is made by adding them to the Basket or removing them from the Basket.
An order shall be fulfilled on condition that the Goods are available in the warehouse of the Online Store. In the event of non-availability of the Goods, an appropriate message shall be displayed on the website.
In the course of submitting the Order - until the button with the selected payment method is pressed - the Customer shall be able to modify the entered data as regards the selection of the Goods. For this purpose, the messages displayed and information available on the site shall be followed.
After the Customer using the On-line shop has provided all necessary data, a summary of the Order shall be displayed.
The summary of the Order shall contain information concerning in particular:
Goods ordered,
Unit price and total price of the ordered Goods,
The chosen method of delivery and the time limit for payment,
Costs of delivery,
Selected method of payment,
Selected delivery address,
Method and date of payment.
Sending the Order by the Customer constitutes a declaration of will to conclude a Sales Agreement with the Seller, in accordance with the content of the Terms and Conditions.
After placing the Order, the Customer receives an e-mail message containing the final confirmation of all the essential elements of the Order.
The Contract is considered concluded at the moment of receiving by the Customer the e-mail message referred to in passage 8 of this paragraph.
§ 5 Method and conditions of delivery of the Goods
Delivery of the Goods is restricted to the territory of the European Union and the European Economic Area ( European Economic Zone ) and takes place to the address indicated by the Customer in the course of placing the Order.
Delivery of the Goods ordered in the online shop www.manufakturanatura.com is realized through: courier company, Poczta Polska.
Delivery will take place within the timeframe specified in the document "Transport and delivery".
§6 Prices and payment methods
The prices of the Goods are given in Polish zloty or in Euro and include all components, including VAT (with the distinction of the rate) and all other components.
The Client can choose the following methods of payment for the ordered Goods:
bank transfer to the bank account of the Seller (in this case, the processing of the order will be commenced after the confirmation of acceptance of the order has been sent to the Client by the Seller, and the shipment will be made immediately after the funds have been credited to the Seller's bank account. In case the payment is not settled within 3 days from placing the order, the Seller reserves the right to withdraw from the contract and automatically cancel the order;
bank transfer via PayU, an external payment system operated by PayU S.A. with its registered seat in Poznań (in this case, processing of the order will commence after the Seller has sent the Client a confirmation of accepting the order and after the Seller has received information from PayU that the payment has been made by the Client);
bank transfer through an external payment system Przelewy24, operated by PayPro S.A. with its registered seat in Poznań (in this case, order processing will begin after the Seller has sent the Client a confirmation of order acceptance and after the Seller has received information from the Przelewy24 system that the payment has been made by the Client);
§7 Right of withdrawal
Each customer, being a consumer as defined by article 221 of the Civil Code and using the Online Store, shall have the right to withdraw from the concluded contract of sale of the Goods, pursuant to the Act on Consumer Rights, without giving reasons, within the period as specified below. The statement of withdrawal shall be sent to the address:

By e-mail - mn@manufakturanatura.pl, indicating in the title of the e-mail the number of the Order and the words "withdrawal from the contract".
The consumer shall have the right to withdraw within a maximum period of 14 days, which shall commence on the date of receipt of the Goods by the consumer. The deadline shall be deemed to have been met if the consumer sends a notice of withdrawal to the above address before the deadline expires.
The consumer's right of withdrawal is excluded for Goods that have been opened/used by the Customer.
In the case of withdrawal from a remote agreement, the agreement is considered as not concluded. What the parties have provided shall be returned in an unchanged state. The return should be made immediately, not later than within 14 days.
The purchased goods should be returned to the address: ManufakturaNatura.com ul. Zgłobicka 30, 33-113 Zgłobice.
Goods returned by the Customer should be packed in a way that ensures no damage to the parcel during transport.
If an order is made with the option: pick up at a point and the package is not collected due to Customer's fault, the Customer shall have the right to withdraw from the contract, while the refund for the order shall be reduced by the actual shipping costs incurred by the shop.
§ 8 Complaints
Complaints arising from infringement of the Customer's rights and relating to the functioning of the Online Store should be sent to the following address: ManufakturaNatura.com ul. Zgłobicka 30 33-113 Zgłobice, The Seller undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period in which the complaint will be considered.
The Customer has the right to pursue claims resulting from the Order in court proceedings after the complaint procedure has been exhausted.
§ 9 Newsletters
The Customer may agree to receive commercial information, including commercial information by e-mail, by ticking the appropriate option in the registration form or at a later date in the appropriate place on the website www.manufakturanatura.com . In the case of such consent, the Customer will receive the Newsletter as well as other commercial information sent by the Company on its own behalf or on behalf of third parties at the e-mail address provided by the Customer.
The Customer may, at any time, resign from receiving the Newsletter and other commercial information by checking the appropriate box at the Online Store website.
§ 10 Final provisions
Settlement of any disputes arising between the Company and a Customer who is not a consumer as defined in art. 221 of the Civil Code, shall be submitted to the court having jurisdiction over the Company's registered office.
The Online Store conducts the policy of protection and processing of Customers' personal data in accordance with the Act of 29 August 1997 on the protection of personal data, as well as the Privacy Policy available at any time on the website www.manufakturanatura.com. The Customer has the right to access his/her personal data and to correct and delete them.
In matters not regulated herein the provisions of the Polish Civil Code, the provisions of the Act on Rendering Electronic Services and other relevant provisions of Polish law shall apply.
